From time to time we may modify the terms and conditions. Accordingly, please continue to review the terms and conditions whenever accessing or using the website. If at any time you do not wish to accept the terms and conditions, you may not use the website.

General
These terms and conditions do not affect your statutory rights. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

You undertake that all details you provide to Tool Garage for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
Tool Garage cannot be held responsible for any incorrect information supplied by you/credit card/debit card issuing company that leads to an incorrect delivery address and or personal details.

Payment and Price
The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier’s prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order. All prices on our website are inclusive of VAT.

Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.
Due to the limited availability of items purchased in our special offers and clearance section we cannot guarantee fulfilment of your order. In the unlikely event we are unable to provide the item we will not charge you for these and we will refund any money already paid for them. Payment Methods
We accept all major credit and debit cards including Visa, Mastercard and Switch. All payment will be processed through CardSave. CardSave is a member of the WorldPay Group, the UK's largest card processor. CardSave are one of the most trusted payment processers in the world. They are renowned for their safety and security.
On orders, you must provide us with your exact billing address and telephone number - the address and phone number your credit card bank has on file for you.

Delivery
We reserve the right to deliver your goods within a maximum period of 30 days from the point of order, unless a longer period is agreed in writing. We do not accept any responsibility of non delivery due to a third party courier, the Couriers will attempt delivery twice, after this, you as the customer are obliged to collect the goods from your local branch.
Delivery prices quoted are for most UK Mainland addresses. Northern Ireland(BT), Isle of Man(IM), Scottish Highlands and Orkney Isles(PA, ML, EH, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles(HS, ZE) will incur additional charges and may also experience delivery delays. AM and Saturday deliveries are optional and will also incur additional charges. These can be obtained upon application. Please email us for quotation.
If your delivery address is outside of the United Kingdom you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; Tool Garage advises each customer to contact their local customs office for further information. Tool Garage may engage a 3rd party to fulfil orders, a contract for the sale of these products will be made between the 3rd party supplier and yourself. Please note that when shipping products internationally you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

Product Ownership
As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.
Tool Garage shall under no circumstances be liable for any consequential or indirect damage or loss, however caused, including (but not restricted to) loss of profits, loss of goodwill, damage to trading relationships, and financial loss.

Time Limitation for Notification of Claims
Damage in transit: If goods arrive in a damaged condition you must make a note on the carrier’s delivery consignment note and it will be your responsibility to inform us within 48 hours from delivery.

Shortages: It is your responsibility to sign for the correct number of packages as shown on the carrier’s delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 48 hours from delivery.

Incorrect Goods: It is your responsibility to notify us of any in-correct goods supplied within 48 hours days from delivery.

Faults: A product is deemed to be faulty on arrival if it shows symptoms of a failure preventing basic operation upon its first use out of the box. In such instances please contact customer services within 7 days from the delivery date. You can then either return the faulty item directly yourself or we will organise a collection.

Non-Deliveries: We will not accept liability for goods lost in transit unless we are notified within 10 days from the expected delivery date. If goods returned under this clause are found to be perfect and in full working order, these will be returned to you and an administration fee of 15% of the price of the goods along with the cost of carriage will be charged to your credit card account.

Product Returns

Faulty products
If you receive a faulty product please contact us at contact@toolgarage.co.uk. All products are subject to inspection, upon which will be offered the following options:

  • A replacement: this item will be shipped to you at our expense.
  • A repair: the repaired item will be shipped to you at our expense. Please note that once repaired the product is no longer eligible for replacement.
  • A refund: provided the item has been verified faulty and is complete with all accessories in its original box and packaging.

If the product is faulty, we will pay for the postage to return it to us (return postage should be at reasonable cost).
If a returned product is found to be not faulty, the product will be returned to the customer at their expense.

Non Faulty Items
If you have simply changed your mind about any item ordered cancellations must be received in writing either by post or email within 7 days working days from the following day of delivery in accordance with the Consumer Protection (Distance Selling) regulations 2000.
All returned items should be ‘as new’ with all accessories supplied at time of delivery. We are unable to accept used items back unless found to be faulty.

Any requests for return and or cancellation outside of the initial period may be rejected. All returns and or cancellations must be accompanied with proof of purchase. If returning a non faulty item it is your responsibility to ensure this item is returned to us safely. Neither the original postage costs nor the return postage costs will be refunded. These are the Buyer’s responsibly.

Please note that a 15% restocking fee may be applied to non faulty items returned.

Product Warranties
All products supplied are covered by the terms and conditions of the Manufacturer’s Guarantee for a period of 12 months. This guarantee specifically excludes faults caused by accident, neglect, and misuse. In addition routine maintenance: machinery (greasing/lubricating any moving parts etc.), cosmetic damage is not covered.

The buyer will be wholly responsible for the cost of return delivery and safe return of the goods. Proof of postage is not proof of delivery and you are therefore strongly advised to send your package by recorded delivery, registered post or courier, and to maintain sufficient insurance to cover the value of the goods.

Governing Law & Jurisdiction
The Terms are governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English courts.

Wholesale/Trade Terms and Conditions of Sale

Items that are sold on a Wholesale/Trade basis are sold in accordance with the terms and conditions set out below.

Our general returns policy does not apply to Wholesale/Trade products. Please see below.

Usage of item should be in accordance with the terms below. Terms include but are not limited to the following.

Returns are not accepted on goods sold as Wholesale/Trade sales.

Be sure to spend time reading and following all instructions and safety precautions before and during use of machine. This will also ensure a longer life.

Usage of this item must be in accordance with the manufactures manual, recommendations, specification and any other information provided by the manufacture.

Please note that all Generators are ‘Standby Only’ Generators, and therefore are not made to run continuously. Continuous running should be no longer than the stated time by the manufacture.

Regularly checks and maintenance should be carried out in accordance with the manufacture instructions, to ensure smooth running.

If the product develops a fault during the first 12 months (excluding normal wear and tear items), we have the option of either sending you a replacement part or have you return the item for repair.
All return shipping is at the buyers’ expense. The item/faulty part must be returned to us along with the original proof of purchase

Failure to follow comply with any of the above terms will void any warranty.
